to request information relating to any changes to contracts at your school for
the Autumn Term 2004. This
information is required by 2nd
July 2004.

For all
temporary appointments, whether it be for extensions to existing contracts or
for new starters, it is essential that the end date, together with the
reason for the temporary nature of the contract, is given to enable the
relevant documentation to be issued. When
using the electronic termly reminder, a drop down list is accessible which will
help in this respect.

paper documentation, ie application form, as soon as possible thereafter.

EPS of changes as these occur (%/hours changes, leavers, etc).
Paper copies
of Termly Reminders will also be provided this term, however use of the on-line
facility, would be appreciated. If you have any comments or suggested
improvements these will be gratefully received.
When sending data on line press CONFIRM button, the next screen will
allow you to print the data, to send to EPS press SUBMIT. When data has been
submitted successfully to EPS a message will appear on screen to confirm this.
If a payslip is received for an employee who has previously terminated
employment at the school please notify EPS immediately. The green staff return
is used by Payroll – please inform EPS direct of any staffing issues.
I attach, for
your information, a copy of a letter which is being sent to support staff who
have worked after 1st April 2004. This relates to the Working Time
Regulations 2001 and the entitlement to Paid Annual Leave, together with the
current APT&C salary scales with rolled up rates (pay award pending) and
Local Government Pensions Scheme information.
It has been
brought to our attention that completion of claim forms can be difficult (Notes
are provided on the reverse of forms). However, to ensure that employees are
paid the correct rate, and are able to join the appropriate Pension Scheme, it
may be necessary to contact schools to check details.
All claims
should be fully completed with employee
number, cost centre and project code,
and authorised by the Headteacher or other designated signatory. Incomplete
forms may be returned to the school, resulting in delayed payment of salary to
the employee.
If claim forms
need to be coded/authorised elsewhere, ie the Professional Development Centre
–use a separate claim form for this work – and send immediately to the PDC to
avoid any delay in payment, as these claims take considerably longer to reach
EPS.

Dear
WORKING TIME REGULATIONS 2001 – Entitlement to Paid Annual
Leave
The
Working Time Regulations (Amendment) 2001, provided for paid holiday for all
employees, regardless of length of service or the number of hours worked.
This in effect
means that all paid support staff working in schools are now entitled to
receive holiday entitlement of a minimum of 22 days (pro rata) per year. This would naturally include everyone on a
contract, and staff in this position already receive an allowance in their
annual salary calculation equivalent to their personal annual leave
entitlement.
However,
the regulations now mean that anyone working at a school including those on a
casual, (as and when required basis), is now also entitled to have paid
holiday. Therefore all support staff
currently paid by casual claims should also now receive a paid holiday allowance.
Clearly
it is impractical for support staff in this situation to actually receive paid
annual leave, and the solution being adopted across the County Council is to
roll up the entitlement into an individual’s hourly rate, which will be
increased accordingly.
In order to comply with legislative
requirements, I am now writing to inform you of your entitlement to annual
leave and that it is being paid as an addition to your hourly rate.
Therefore,
for all casual work undertaken in schools and paid on a claims basis with
effect from 1st April 2004, the hourly rates will be increased to
take account of annual leave entitlement under the Working Time Regulations.
A copy of the current pay
scales is attached which clearly states the Hourly Rate, Enhanced Hourly Rate
and Holiday Pay Entitlement.
Casual claims should only
be used when the reason for doing so is a truly casual situation, e.g. to cover
for the short-term absence of a member of staff, or a peak in workload.
If your employment pattern
is regular and is expected to continue beyond
four weeks, then a contract of employment should be offered. – please
speak to your Headteacher regarding this, or alternatively contact the number
on the head of this letter for further advice.
This regulation does not
apply to anyone undertaking additional hours in their substantive post, these
hours will continue to be paid at the relevant rate.
