Royal Wedding 29th April 2011

Following the announcement of the additional Bank Holiday on 29 April 2011 in celebration of the Royal Wedding, please note the following arrangements:

Teaching staff

The Department for Education has announced that it is making arrangements to amend teachers' terms of employment so that they are required to attend for work on 194 days during the 2010/11 academic year by making changes as follows:

The Education (School Day and School Year) (England) (Amendment) Regulations 2011 amend the Education (School Day and School Year) (England) Regulations 1999, which stipulate the minimum number of sessions which must be held in each school year for all maintained schools in England. These amendment Regulations reduce the minimum number of sessions for the school year 2010-2011 from 380 sessions to 378 sessions, i.e. from 190 days to 189 days. Similar regulations have made in Wales.

The School Teachers' Pay and Conditions (Amendment) Order 2011 modifies the School Teachers' Pay and Conditions Document 2010 by reducing the number of days for which a teacher must be available for work in the 2010/11 school year by one day, and to make a corresponding modification in relation to the number of hours during which teachers can be required to perform their duties in that school year.

The Modifications will result in a reduction in the number of days a teacher employed full time must be required to work from 195 to 194 days, and a reduction in the number of days they may be required to teach pupils and perform other duties from 190 to 189 days. There is a corresponding reduction in the number of hours during which a teacher employed full time is required to perform their duties - from 1265 to 1258.5 hours.

In order to allow all teachers to have the benefit of the additional Bank Holiday, we advise that the following arrangements apply in schools:

Schools which are not scheduled to close on 29 April 2011 as part of their Easter break must do so.

Schools which are already closing on 29 April as part of their Easter break should designate an additional day as part of the school closure period. Our recommendation is to add this additional day's closure to either the beginning or end of the mid-term break in the summer term or to the beginning of the summer break. In order to achieve this change to the school calendar, staff, the recognised local trade union representatives and parents should be notified as soon as possible.

Thus, full-time teachers will be required to attend for one fewer pupil contact or non-pupil (INSET) day during the 2010/11 academic year.
Similarly, part-time teachers who would have been scheduled to work on 29 April or the alternative closure day designated by the school will not be required to attend on this day.

Part-time teachers who would not have been scheduled to work on 29 April or the alternative designated day should be given a compensatory day off on one of the remaining 194 teaching or non-pupil days. Where the part-time teacher is given time off during a period when they would normally be teaching, the school will have to make alternative arrangements for those pupils who will not be taught by their usual teacher during this time.
The above arrangements would have no impact on the pay of any full or part-time teacher.

Please note that the proposals relating to part-time teachers set out above will not meet the precise requirements relating to the exact tie up between pro rata pay and working time, as defined in the STPCD. However, our advice is that the complexity of making a specific calculation for each part time member of staff - to ensure they undertake the correct pro rata directed time in line with their pro rate pay is not worthwhile, particularly given that it might actually include the making up of any time they have had over and above their entitlement.

Support Staff

In accordance with Part 2 Para 7.1 of the Green Book Conditions of Service, employees will be entitled to a holiday with a normal day's pay on this additional Public Holiday

Despite this reduction in the school year to 189 days, the salary calculation for term time only staff should continue to reflect the usual pupil year of 190 days but part-time staff who would not normally work on that day will be entitled to time of in lieu on the basis of their normal working hours, this to be managed by Headteachers on a case by case basis.
