Changes in School Teachers Pay and Conditions 2011
The outcome of consultations on changes to teachers' pay and conditions have been concluded and the School Teachers Pay and Conditions Document 2011 was laid before Parliament on 10th August, and came into force on 1st September 2011 subject to the normal parliamentary process.
Summary of changes in Pay and Conditions from September 2011
The introduction of a 25% limit to any discretionary payment which can be made to a head teacher. A £250 payment to those unqualified teachers who earn a full time equivalent salary of £21,000 a year, or less. As a result of the extra bank holiday to celebrate the Queen's Diamond Jubilee in 2012, for the academic year 2011/12, teachers must be available to work for 194 days (1258.5 hours). There are no other changes to pay scales from September 2011.

Discretionary Payments for Head Teachers
This change restricts the value of any discretionary payments made to head teachers, in any school year, to 25% of the value of their salary point.
All discretionary payments received in relation to their role as head teacher count towards this limit. These include payments in respect of:
Continuing professional development Initial teacher training activities Out of school learning activities Recruitment and retention Additional responsibilities due to the provision of services relating to the raising of standards to one or more additional schools
This limit does not include payments where:The head teacher is receiving payment for residential duties, where these are a requirement of the job The head teacher has been appointed, on either a permanent or temporary basis, as head teacher of more than one school, or The head teacher is receiving payment for relocation expenses
These provisions only affect decisions on pay made on or after 1st September 2011.
If it proposed that a discretionary payment be made that would exceed the 25% limit, the governing body must seek external, independent advice from a person or body who can consider the provisions of the Document.
Individual School Ranges (ISR's)
The 2011 Document has introduced the following additions or amendments in relating to Individual School Ranges.
Where a relevant body has determined an individual school range that exceeds the highest point on the leadership group pay spine, that body must continue to determine the value of each point above the highest point for as long as that ISR applies Where the relevant body makes a determination of an ISR on, or after, 1st September 2011, the maximum value must not exceed the maximum of the head teacher group range.
These two changes make it clear that the new provisions of the 2011 Document are not intended to be used to re-determine the pay of a head teacher that has already been determined under a previous document, even where the ISR is above that which would be allowed under the new provisions.
Unqualified Teachers Pay
New provisions apply at Paragraph 35 relating to the pay of unqualified teachers earning less than £21,000 a year.
In the case of a teacher who is on Point 1, 2 or 3 of the unqualified teachers' pay scale, they will receive an additional £250 for 2011/12. This is in line with the exception to the Government's public sector pay freeze, giving some protection for the lower paid.
Section 3 of the document specifies that the £250 should be paid on a monthly basis, pro rata for part time teachers. Any written statement detailing the teacher's pay should show the £250 as a separate payment as the value has not been consolidated into the pay scale.
Additional Bank Holiday for the Diamond Jubilee - 5th June 2012
Paragraph 62 of the STPCD 2011 has been amended so that the number of days on which a full time teacher must be required to work is reduced from 195 days to 194 days, and the number of days they may be required to teach and perform other duties reduced from 190 days to 189 days.
There is a corresponding reduction in the number of hours during which a teacher employed full time is required to perform their duties from 1265 hours to 1258.5 hours.
Full time teachers will be required to attend for one fewer pupil contact day in 2011/12; however, for the avoidance of doubt, the published term dates for 2011/12 already reflect this and having been reduced from 190 days to 189 days.
The above arrangements will have no impact on pay of any full or part time teacher employed on a contractual basis.
However, for supply teachers, for the academic year 2011/12 only, the daily and hourly rates have been calculated on the basis of a school year of 194 days and 1258.5 hours. This is due to the additional public holiday in 2012 to celebrate the Queen's Diamond Jubilee, and the method of calculation will revert to 195 days and 1265 hours from September 2012.

This policy will be reviewed in the Autumn Term. Subject to consultation with the relevant trade unions, it is expected that the revised version will be available in December.
