Teacher Appraisal and Capability

Revisions to the appraisal arrangements for teachers come into force with effect from 1st September 2012.

They are set out in the Education (School Teacher's Appraisal (England) Regulations 2012 which replace the Education (School Teacher Performance) Regulations 2006. www.legislation.gov.uk
However, the 2006 regulations will continue to apply to any performance management cycle that is in progress on 1st September 2012 unless the school decides to end that cycle early and to begin a new appraisal period starting on or after that date.

The purpose of this communication is to inform you that local authority officers are drawing up revised Performance Management and Capability procedures and will be discussing these with the recognised teacher unions shortly, with a view to publishing these for schools to adopt as their policies. You are advised to await these, as they will represent variations on current policies and will have been through consultation with the County Secretaries for the Trade Unions.

The reason for the proposed change in the capability procedures is to enable issues of performance to be addressed informally within the Performance Management process. It will remain the case that capability procedures will only apply to teachers and headteachers about whose performance there are serious concerns that the appraisal process has been unable to address.
