New Requirements for Schools when Providing References to Other Employers
From 1st September 2012 there are new requirements for schools arising from revisions to the School Staffing Regulations (England) 2009 regarding teachers who have been subject to the schools capability procedure.
The amendments mean that schools are required to pass on information to prospective employers about teachers and headteachers, who have been subject to capability procedures. This is in relation to formal capability procedures only (please note teacher capability regulations have recently changed and are explained in MI sheet 156/12).
The new requirements mean that when a teacher applies for another teaching post at a maintained school or an academy the governing body of the teacher's current school must inform, at the request of the prospective employer (maintained school or academy), whether that teacher has been subject, in the last two years, to the school's capability procedure. The governing body should provide, in writing:
details of the concerns
the duration of the procedure
the outcome of the procedure.
This is likely to be requested by the prospective employer as part of the request for a reference.
Governors, Headteachers and school leaders should ensure that this information is included in any response to a reference request from other maintained schools and academies, where it is applicable.
