Equality Act Technical Guidance
The Technical Guidance for schools has been issued by the Equality and Human Rights Commission. This is the final version following consultation with a variety of representatives across the education sector, including colleagues from Norfolk.
The Guidance outlines the requirements of the Equality Act 2010 for schools in relation to the provision of education and access to benefits, facilities or services, both educational and non-educational, that a school provides or offers to provide for pupils. It provides an authoritative, comprehensive and technical guide to the detail of the law.
The Guidance is not a statutory code but it may be used as evidence in legal proceedings. Where schools follow the Guidance it may help them avoid a court making an adverse decision in such proceedings.
It is available at: http://www.equalityhumanrights.com/uploaded_files/EqualityAct/PSED/technical_guidance_schools_england_final.pdf.
Schools should take particular note of the extension of the reasonable adjustments duty to include auxiliary aids and services to disabled pupils that came into force on 1 September 2012.
