Changes to Construction, Design and Management Regulations (CDM) - action needed for the transition where you are directly contracting works which fall under the CDM (work has not been contracted by NPS)

New Construction (Design and Management) Regulations 2015 (CDM 2015) will come into force on 6 April 2015.

There will be a transitional period that will run for six months from 6 April 2015 to 6 October 2015. This document provides you with details of what action you might need to take now. Please read this document and take action if you are having construction work carried out that will start before the 6 April and continue after that date.

New guidance will be published shortly for you to use for CDM activities that start after 6 April.

What will change?

Principal designer. The replacement of the CDM co-ordinator role (under CDM 2007) by a principal designer. This means that the responsibility for coordination of the pre-construction phase – which is crucial to the management of any successful construction project – will generally rest with an existing member of the design team.,/p>

Client. The new Regulations recognise the influence and importance of the client (the school) as the head of the supply chain and they are best placed to set standards throughout a project.

Competence. New information will clarify how to assess and demonstrate that construction project teams have the right attributes to deliver a healthy and safe project.

What do you need to do?

  1. You are having construction work carried out by one contractor only
  2. The contractor must draw up a construction phase plan. Please note, where works are already being carried out and will continue at 6 April, a construction phase plan must be drawn up as soon as practicable after 6 April.

    Action for schools

    Ensure that your contractor has a construction phase plan (please note, contractors can find a basic template on the HSE website for use for small projects and routine work).

  3. Construction Projects with an existing CDM co-ordinator that starts before 6 April and continues beyond 6 October
  4. A principal designer needs to be appointed (in writing by the Client) for the project before the 6 October 2015.

    Please note: The CDM co-ordinator continues to have effect until a principal designer is appointed or the project comes to an end and must comply with the duties set out for the transitional period.

    Action for Schools

    Contact your CDM Co-ordinator, ask them to provide you with confirmation that they will comply with the duties set out for the transitional period of CDM 2015 and anything that they require from you as client (please note, this can be by telephone, email, meeting).

    If your project will last beyond 6 October 2015 contact healthandsafety@norfolk.gov.uk for further advice on what you need to do.

  5. Projects with no existing CDMC or Principal Contractor

Where immediately before 6 April:

  • No CDM Co-ordinator or Principal Contractor was required and
  • There is more than one contractor or it is foreseeable there will be more than one contractor and
  • Construction Phase has started

Action for Schools

Appoint the main contractor as the Principal contractor in writing (email is sufficient) as soon as practicable after 6 April please note: if you don’t appoint a Principal contractor, this means that you must fulfil the duties of the Principal contractor.

The Principal Contractor must draw up a construction phase plan or make arrangements as soon as practicable after 6 April and provide this to you.
