Temporary Management Allowances
I refer to MI Sheet MI/57/05 of 19th March 2005, which gave details of likely forthcoming changes to Teachers' Pay and Conditions, most particularly the introduction of Teaching and Learning Responsibility Payments (TLR's). The intention now is that TLR payments will be payable from 1st January 2006.The purpose of this MI Sheet is to clarify the arrangements for new management points awarded from 1st April 2004 which could only be granted temporarily for a maximum of 12 months until 31st March 2005 pending forthcoming changes to pay and conditions. The arrangements in this letter would also apply in circumstances where a school wished to award a fresh management allowance where the responsibilities of the post will commence prior to 31st December 2005.
Arising from the information in the last MI Sheet about TLR's and other changes, it is now clear that a new award of a further temporary management allowance can be made after 31st March 2005 if required for a period of up to one year.
My advice would be that schools should consider awarding new temporary allowances from 1st April 2005 for a maximum period of 12 months where they judge that there is a continuing need for the teacher to retain that level of responsibility. Clearly, it would be sensible to provide the award of new temporary management allowances only for those duties which are likely to meet the test for the award of TLR payments. This would minimise the need to safeguard management allowances when the new TLR payment structure is implemented.
Although you may well have responded to the “Termly Reminder” sent to you last month, your Personnel Assistant will require a separate and specific instruction from you for each member of staff in this category, in order to be able to reflect this in contractual and pay terms. The reason for this is that the Personnel Assistant will not necessarily be able to distinguish between a contract that is required to continue from that which is required to end, for a variety of reasons, unless notified by you.
Upon receiving your instruction, the Personnel Assistant for your school will issue a letter extending the temporary management allowance for the reasons you require. If the reason for the fixed-term nature of the award is related to the introduction by the school of TLR's, the following standard text will be used:-
"Your current temporary Management Allowance ceased under the terms of your contract at 31st March 2005. However, I am pleased to confirm that a new temporary management allowance will be awarded for ..... month period up to ..... whilst you are continuing to carry out these duties. After that date your salary will be determined by the Governing Body in accordance with the Teachers' Pay and Conditions Document and could be either:-
- replaced by a Teaching and Learning Responsibility Point or
- reverted to your substantive post (on main grade or a lower management allowance). If the latter is the case, once the substantive post becomes rescinded you will be subject to safeguarding arrangements to be determined in accordance with the pay and conditions document."
