School Teachers' Pay and Conditions Document and Guidance 2005

Set out below is a summary of main changes to pay and conditions since 2004, i.e. including changes already introduced in April 2005 and those to be introduced from September 2005.

Change Teachers' Pay and Condition Document Reference
New sets of pay scales which have effect from 1st September 2005 - 31st August 2006. Paragraphs 6.4, 17.3, 19.2, 30.1 and 40.1
Management Allowances may not be awarded after 31st December 2005 and safeguarding arrangements are in place for former management allowance holders. Paragraphs 23 and 24
Revised salary statements must be issued by 31st January 2006 to all holders of management allowances. Paragraph 49.5
Teaching and Learning Responsibility Payments (TLRP's) may be made from January 2006 in accordance with the School's Pay Policy and adopted staffing structure and safeguarding arrangements to be in place where appropriate. Paragraphs 25 and 26
Members of the Leadership Group and Advanced Skills Teachers (AST's) who will or may have their salaries reduced as a result of an internal re-organisation are subject to safeguarding and must receive notification within a month of determination of the safeguarding to which they will be subject. Paragraph 26.3
All safeguarding is fixed term for up to three years and is cash based, except for teachers subject to general safeguarding arrangements to which general safeguarding arrangements apply before 1st January 2006. Paragraph 24.3
All teachers in receipt of safeguarding sums totalling more than £500 may be required to carry out work commensurate with those sums and safeguarding will be lost if they unreasonably refuse to do so. Paragraph 5
All teachers who lose their post, or would suffer a reduction in salary, as a result of a closure/re-organisation (including where discretionary decisions have been made to safeguard in cases involving internal school re-organisation or redeployment) up to and including 31st December 2005 are subject to indefinite safeguarding. Paragraph 48 of Section 2
Headteachers whose Individual School Ranges (ISR's) are reduced prior to 1st September 2005 and who find themselves on protected points continue with previous protection arrangements. Their salaries will increase in line with annual pay increases as at present, rather than being subject to three-year cash protection. Paragraph 50
From 1st January 2006, under the new rules mandatory general safeguarding, for up to three years, applies in all cases of closure and re-organisation, including internal school re-organisation and circumstances where teachers are redeployed. (This will be of particular interest to schools subject to School Re-organisation Review.) Annex 6 (paragraph 48A)
Provision is made for the introduction of the Excellent Teacher Scheme (ETS) from 1st September 2006. Paragraph 38
From 1st September 2005, unqualified teachers' pay points are permanent whether they remain in the same post or take up a new one. Paragraph 40.6
Included in the Document and arising from the National Agreement on Revising Standards and Tackling Workload from September 2005:-
  • all teachers will have guaranteed planning, preparation and assessment time (PPA) Paragraphs 62, 65 and 70
  • all Headteachers will have dedicated headship time. Paragraph 61
  • teachers will not be required to arrange or supervise public examinations.
Paragraph 73.10
The following changes have been made to the statutory pay guidance:-
  • A sentence has been added to indicate that where a teacher has moved school in the assessment period for UPS2 or UPS3, the Headteacher should consult with the Headteacher of the teacher's previous school regarding the teacher's suitability for progression; Section 3, paragraph 29
  • Additional clarification regarding the award of temporary TLRP's. Section 3, paragraph 60
  • Clarification has been added regarding the eligibility of Excellent Teachers to apply for posts.

The statutory pay guidance is still subject to statutory consultation and as a result no doubt some additional points of clarification will emerge. These will be included in any additional explanatory material we issue.

I started to undertake work on revisions to the Norfolk Model Pay Policy, to include these additional provisions and also an Appendix where you will be able to attach, by 31st December 2005, the School's revised structure, as required and to reflect the demise of Management Allowances and the introduction of Teaching and Learning Responsibility Payments. Any revisions to the Model Pay Policy are subject to consultation with the recognised Trade Unions but I will endeavour to make these available as soon as possible. In addition, we hope to issue further documentation to help you notify staff where they are to be affected by change.
