Annual Review of EHC Plans - Interactive Sessions

We want to share our approach with you for both annual reviews and to improving the quality of existing EHC Plans.

As you will be aware in line with SENDCOP 9.166 EHC plans should be used to actively monitor children and young people's progress towards their outcomes and longer-term aspirations. They must be reviewed by the local authority as a minimum every 12 months and every 3-6 months for children in early years. Reviews must focus on the child or young person's progress towards achieving the outcomes specified in the EHC plan. The review must also consider whether these outcomes and supporting targets remain appropriate.

Circumstances in which a local authority must review an EHC plan

18.-

(1) Except where paragraph (3) applies, where a child or young person is within 12 months of a transfer between phases of education, the local authority must review and amend, where necessary, the child or young person's EHC plan before-

(a) 31 March in the calendar year of the child or young person's transfer from secondary

  • school to a post-16 institution; and
  • (b) 15 February in the calendar year of the child's transfer in any other case,

  • and where necessary amend the EHC plan so that it names the school, post-16 or other institution,
  • or type of school or institution, which the child or young person will attend following that transfer.
  • (2) Where it is proposed that a young person transfers from one post-16 institution to another post-16 institution at any other time, the local authority must review and amend, where necessary, the young person's EHC plan at least five months before that transfer takes place so that it names the post-16 institution that the young person will attend following the transfer.

    We have designed a new Annual Review document which has been streamlined to ensure we are capturing the correct advice and evidence as per SENDCOP and should make the process easier, which we would like to guide you through, this will be launched next academic year 2021/22.

    We will be holding twilight sessions over the next term we will cover statutory school age children, Early Years and Post-16 on all sessions. The sessions will be interactive with opportunities for Q&A. and will include:

    • LA & Settings responsibilities around the Annual Review Process.
    • The new Annual Review documentation.
    • How we are going to review the quality of all CYP's EHC Plans
