Revisions to "Keeping Children Safe in Education" DfE

Revised Statutory Guidance

On 6 July 2021, the Department for Education (DfE) published a revised version of 'Keeping Children Safe in Education'. The revised guidance for is information only at this stage so that schools and colleges can plan for the commencement of the guidance on 1 September 2021; until this time, the existing statutory guidance, 'Keeping Children Safe in Education' 2020 is still in force and schools and colleges must continue to have regard to it.

In addition, the DfE has updated the guidance: 'Sexual violence and sexual harassment between children in schools and colleges' (September 2021). This guidance does not come into force until 1 September 2021 and schools and colleges must continue to use the 2018 version until then.

Key Changes

Annex G of the draft guidance includes a table of substantive changes from the 2020 document. You will see that the guidance has been expanded in a number of areas and safeguarding practices will need careful consideration in accordance with these changes.

Some of the most significant revisions to the document include:

Summary

KCSIE now applies to providers of post 16 education as set out Education and Training (Welfare of Children) Act 2021

Clarification provided that the guidance for senior leadership teams and explanation of condensed Part one of the guidance at Annex A.

Part one

Guidance in this section has been expanded to include further information and emphasis on staff knowledge of:

  • The need for reassurance for victims that their concerns will be taken seriously, they will be supported and kept safe;
  • Online abuse including the consensual and non-consensual sharing of nudes and semi nudes images and or videos;
  • All forms of child exploitation including criminal, sexual and serious violence;
  • Peer on peer abuse.

There is also more detailed advice about safeguarding record keeping practices and expectations for staff.

Part two

A new section on whole school and college approaches to safeguarding. Including a whole school/college approach to peer on peer abuse along with clear and easily accessible systems for children to confidently report abuse.

Emphasis on the need for Governing bodies to:

  • consider the level of information that is provided to temporary staff and volunteers;
  • ensure child protection files are maintained and appropriate safer recruitment policies are in place in accordance with the guidance.

Emphasis on ensuring regular programme of safeguarding training and awareness that is aligned to the whole approach to safeguarding including wider staff training and curriculum planning.

Online safety needs to be seen integrated into the whole-school approach and safeguarding policy framework. Key issues such as remote learning, filters and monitoring and information security are highlighted for consideration.

Guidance on the use of school or college premises for non-school/college activities, when the settings safeguarding policy will apply and the assurances they should seek.

Additional emphasis on children missing education and elective home education and the response of education settings to these issues in line with guidance and legislation.

Further guidance on the role of the senior mental health lead.

Part three

There have been substantial revisions to this section which is now divided into 4 parts including further guidance on the stages of the recruitment and selection process and the legal reporting duties of employers.

Part four

There are significant revisions to this part.

The guidance now has two sections covering two levels of allegation/concern; those that may meet the harms threshold and those that do not meet the harms threshold – referred to as 'low level concerns'.

As well as the requirement to have a procedure for dealing with low-level concerns, section one includes more detailed advice on the process of dealing with allegations, including initial considerations, suggested timescales for investigation and the duty of care to employees.

Part five

Further advice is provided throughout this section to support settings to strengthen their policies and procedures in this area in line with the learning from the Ofsted Thematic review of sexual abuse in schools and colleges.

Annex A

The revised guidance introduces a condensed version of Part one of Keeping children safe in education.

Annex B

Further safeguarding information - Annex A in previous versions. Additional information provided in relation to:

  • Child abduction and community safety incidents
  • Modern slavery and the National Referral Mechanism (NRM)
  • County Lines
  • Cybercrime
  • Domestic abuse
  • Peer on Peer abuse
Annex C

(Previously Annex B)

Additional expectations about the role of the DSL are highlighted in this section including:

  • promotion of the educational outcomes of children with a social worker;
  • detailed advice is provided about safeguarding record keeping practices and the responsibility of the DSL;
  • encouraging a culture of listening to children and taking their wishes and feelings into account.
Annexes D, E & F

No significant changes.

What should schools do?

  • Read KCSiE giving particular consideration to the changes regarding the development of a whole school approach to safeguarding including peer on peer abuse, sexual violence and harassment, promoting the educational outcomes of children with a social worker, safer recruitment and responding to low-level concerns.

  • Review all relevant policy documents, procedures and training and devise an action plan to implement required changes.

  • Ensure that the final version of the guidance is accessed and disseminated to staff when it is becomes statutory on 1st September.

In order to support settings with this task, the table of changes included at Annex G of the revised document has been amended to provide additional, local advice and guidance on specific changes. It will be available within the guidance section of the website early next week.

What is the Education Safeguarding Team doing?

We are currently making changes to the model safeguarding policy, forms and templates and the whole school training package to reflect these changes. These documents will be published in the Safeguarding section of Schools and Learning Providers website as soon as possible.

We recognise the complexity and depth of some of the issues raised within the revised guidance. We are therefore linking with a range of colleagues to ensure that we can offer further advice and support in relation to issues such as sexual violence and harassment, online safety, educational outcomes of children with a social worker and procedures for responding to low-level concerns.

Our aim is to offer a programme of thematic training opportunities for Headteachers, DSLs and Governors early in the Autumn Term.
